1. School identity
These Terms & Conditions apply to the use of the Da Silva Academy website (https://dasilvaacademy.co.za) and to parent, guardian, and applicant dealings with the school in connection with admissions, school fees, administration or admission-related fees, and related school services.
Da Silva Academy is a private school based in Rustenburg, South Africa. Company registration number: 2013 / 235089 / 07. Trading / public name: Da Silva Academy.

2. Admissions
Admission to Da Silva Academy is subject to the school’s admissions process, including completed application information, supporting documents, any assessment or interview required by the school, and written acceptance of a place where applicable.
Submitting an application, paying an administration, registration, or admission-related fee, or completing an online payment does not automatically guarantee admission or a place, unless the school’s written offer expressly states otherwise.
The school may decline an application in accordance with its admissions process and capacity. Fee schedules, acceptance fees, and related requirements for a given year are those published by the school or stated on the applicable account or offer.
3. School fees and related charges
Parents and guardians who accept a place remain responsible for school fees, book or textbook charges where applicable, events fees where compulsory, transport, aftercare, intervention, and other charges as set out in the school’s published fee schedule, financial policy, and signed financial agreement for the relevant year.
School fees are generally payable in advance according to the school’s fee schedule and monthly account statements. Unless the school advises otherwise for a specific year, fees are payable by the third day of the month to which they relate, for twelve months of the year (January through December).
Late-payment penalties, events fees, registration confirmation fees for a following year, textbook fees, bus fees, aftercare, intervention, and similar charges may appear on monthly statements where applicable under the school’s published financial policy for that year.
The Board of Directors endeavours not to increase tuition fees during a school year, but reserves the right to do so if circumstances require it, with notice as provided in the school’s financial agreement. An increase may reasonably be expected from year to year to provide for inflation and other costs beyond the school’s control.
4. Administration, registration and admission fees
Acceptance, application, registration, and administration fees charged on initial admission (or as otherwise published for a given intake) are payable as required by the school before an application or place is processed.
In accordance with Da Silva Academy’s established financial agreement: registration and administration fees are not refundable. These fees do not form part of annual school fees unless the school’s published schedule expressly states otherwise.
5. Payment obligations
The parent or guardian identified for accounts remains responsible for payment of all tuition fees and other amounts due in respect of the learner.
Should any instalment remain unpaid for a period of one month, the whole balance of the account may fall due and become payable immediately, as set out in the school’s Contract of Payment / Financial Agreement.
Failure to meet financial obligations may result in the learner forfeiting their place at Da Silva Academy with immediate effect, as provided in the school’s financial agreement and financial policy.
Where accounts are handed over for collection, the responsible party agrees to pay costs on an attorney-and-client scale as well as tracing costs, as set out in the school’s Declaration of Financial Agreement.
Subsidies, bursaries, or estate claims do not remove the parent or guardian’s liability to pay school fees as per the financial agreement; such claims are pursued in a private capacity. The school accepts no responsibility for arranging those claims.
6. Withdrawal and notice
One (1) month’s written notice is required when withdrawing a learner from the school. Both parties who signed the Acceptance of Place form remain liable for outstanding accounts unless another written agreement is lodged with the Finance Office.
November and December are not accepted as notice months.
Failure to give the required notice may result in the account being charged a cancellation fee equal to three (3) months’ school fees, as acknowledged in the school’s Declaration of Financial Agreement.
Upon withdrawal with proper notice, fees paid for periods exceeding the notice period may be refunded as provided in the Contract of Payment. Transfer documentation for another school is handed over once outstanding fees are settled.
One month’s written notice is also required when withdrawing from aftercare and intervention classes. For school bus transport, one month’s advance notice is required; failure to give notice may result in the account being charged for the specific month. December is not accepted as a notice month for bus withdrawal.
7. School rules and policies
Learners and parents are expected to uphold Da Silva Academy’s code of conduct, school rules, and other published school policies (including discipline, homework, assessment, learner support, and related policies as applicable).
Serious breaches may lead to counselling, suspension, or, where reserved to the school’s governing structures, expulsion, in accordance with the school’s disciplinary framework.
8. Parent and guardian responsibilities
Parents and guardians must provide accurate information on applications and accounts, keep contact and address details up to date in writing, and cooperate with the school’s reasonable requests relating to learning, safety, and administration.
Medical emergency authority, sport and outing consent, and related declarations on the school’s application forms remain part of the parent’s undertakings to the school where those forms have been signed.
9. Online payments and PayFast
Da Silva Academy may collect school fees and administration or admission-related fees online. Transaction currency is South African Rand (ZAR). Country of domicile: South Africa.
Online school payments are processed securely by PayFast. Available payment methods are displayed at checkout. Da Silva Academy does not store raw card details.
Successful online payments are applied to the relevant family or learner account according to the school’s payment allocation practices and the payment reference supplied. Parents must use the reference instructed by the school or shown on the account statement.
Electronic funds transfer (EFT) to the school’s bank account, and card payments at the Finance Office where available, may continue to be accepted in addition to PayFast, as advised by the school.
10. Privacy and POPIA
Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and Da Silva Academy’s Privacy Policy. By using this website or submitting information to the school, you consent to processing as described in that policy.
11. Limitation appropriate to school services
Da Silva Academy provides education and related school services. While the school takes reasonable care for learner safety and wellbeing, parents acknowledge the inherent risks of sport, educational visits, and extramural activities, as reflected in the school’s application declarations.
In the event of the school being unable to meet its obligations to the learner or parent for any cause whatsoever, fees paid in advance for any full month will be refunded, and the school shall not be obliged to provide an alternative institution of education, as set out in the Contract of Payment.
Nothing in these terms excludes liability that cannot lawfully be excluded under South African law.
12. Policy updates
Da Silva Academy may update these Terms & Conditions from time to time. The version published on this website with its effective date applies to website use and to online payments made after publication.
Signed financial agreements, acceptance of place forms, and year-specific fee schedules remain binding for the matters they cover. Where a signed agreement and this website differ on a specific financial term, the signed agreement for that learner’s enrolment period prevails for that term, and the school should be contacted for clarification.
13. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa.
Consistent with the school’s Declaration of Financial Agreement, parents consent to the jurisdiction of the Magistrate’s Court of Rustenburg, with the full course of action deemed to have arisen within its area of jurisdiction, without limiting any other forum that may lawfully be available.
